Abstract:

This article examines the potential for employer liability when employees suffer emotional distress during internal investigations of Title VII complaints. It explores the legal boundaries between an employer’s duty to investigate discrimination claims and the risk of causing psychological harm to involved parties. By analyzing case law and statutory frameworks, the article evaluates whether such investigations can give rise to claims of negligent or intentional infliction of emotional distress. It ultimately argues for clearer legal standards to protect both complainants and those under investigation while maintaining the integrity of workplace anti-discrimination procedures.
