How Congress Can Make a More Equitable Federal Arbitration Act

Abstract:

This article proposes amending the FAA to ensure more equitable arbitration contracts and procedures. An amended FAA will save time and expense in predispute contract enforcement litigation.  Part II of this article will briefly describe why the FAA should be amended.  Part III will describe proposed changes regarding contract formation.  Finally, Part IV will focus on other changes needed beyond contract formation in providing a fair arbitration procedure, such as picking neutral arbiters, adequate discovery, and not severely limiting statutes of limitation.
